<p><strong>John Howard, during his time as prime minister, talked a lot about <a href="http://www.ozpolitics.info/guide/rules/rol/">the rule of law</a>. If we are a nation of laws then those laws must, presumably, reflect what we believe about ourselves as a nation. As people. As human beings. As Australians.</strong></p>
<p>Howard, quite correctly, sees a century of the rule of law as one of the great achievements of Australian federation. And yet, under his watch, fundamental legal principles were eroded. Laws made as part of the so-called War on Terror introduced imprisonment without trial, secret evidence, searches without warrant&#8230;</p>
<p>With these conflicting thoughts in mind, I opened the pages of Julian Burnside&#8217;s book <a href="http://www.scribepublications.com.au/book/watchingbrief"><em>Watching Brief: reflections on human rights, law, and justice</em></a> while <a href="http://stilgherrian.com/personal/this_aircraft_will_change_my_life/">leaving Australia for the first time</a>.</p>
<p>As dusk fell somewhere over the Timor Sea, I imagined the horror of traversing that ocean below in an over-crowded, leaky refugee boat only to be hauled off to a concentration camp a quarter of the world away. Meanwhile, I ordered another brandy and Mr Burnside provided me with a concise, clearly-written explanation of just why I&#8217;d been so angry with the Howard government, and so angry with a weak and ineffectual opposition for allowing it to happen.</p>
<p>The book is studded with pertinent observations, explained well. I&#8217;ll mention only two which stood out for me.</p>
<ol>
<li>Our own government was actually cynical enough to call the 9000-volt electric fence around the <a href="http://en.wikipedia.org/wiki/Baxter_Immigration_Reception_and_Processing_Centre">Baxter Detention Centre</a> a &#8220;courtesy fence&#8221;.</li>
<li>Under Australia&#8217;s <em>own</em> laws regarding &#8220;crimes against humanity&#8221; (let alone international law), the extended detention &#8212; sorry, let&#8217;s call it what it is! &#8212; the continued <em>imprisonment</em> of people who have committed no crime (i.e. refugees) is illegal. John Howard, Philip Ruddock and Amanda Vanstone should all be charged. Unfortunately only the Attorney-General can launch proceedings, which Ruddock obviously wouldn&#8217;t do if he were one of those to be charged. However he is no longer Attorney-General.</li>
</ol>
<p><strong>John Howard is gone, but his laws remain. Burnside&#8217;s book provides a useful roadmap for what Kevin Rudd needs to un-do.</strong></p>

<p><strong>Andrew P Street is a genius. I say that because (a) he is, (b) knowing Andrew is one of the three vital components for understanding the full subtlety of this week&#8217;s poll, and (c) I dare not upset him by failing to acknowledge his enormous throbbing brain.</strong></p>
<p>Last night &rsquo;Pong and I went to the <a href="http://www.excelsiorhotelglebe.com.au/">Excelsior Hotel</a> in Glebe. Their website is slick and glossy &#8212; but the web designer has clearly never set foot in the establishment because the Excelsior is what we in the business call a &#8220;dive&#8221;. Or, as the <em>Macquarie Dictionary</em> puts it, &#8220;a disreputable place, as for drinking, gambling, etc.&#8221;</p>
<p>I wish to report that the Excelsior is well-equipped for drinking, and we made ample use of its facilities.</p>
<p>Andrew P Street is, I believe, also well-equipped for drinking, being in possession of hands, mouth, gullet etc. He also has a guitar, and his mouth is so arranged that red wine may flow inwards while, at other moments, song flows outwards.</p>
<p>You may learn much more about Andrew from his <a href="http://www.myspace.com/andrewpstreet">MySpace profile</a> and in particular the blog post <a href="http://blog.myspace.com/index.cfm?fuseaction=blog.view&#038;friendID=72927702&#038;blogID=268173376">The *Real* Andrew P Street</a>. I was moved to learn &#8212; and I&#8217;m sure you will be too &#8212; that:</p>

<p>Andrew P Street was also at the Excelsior last night. But before I elaborate on that, I encourage you to revisit the 1980s and <a href="http://youtube.com/watch?v=MiuimDNlyuQ">listen to a song</a>. </p>
<p><strong>Yes, Samantha Fox, singing <em>Touch Me</em>. Possibly the finest song of the 80s</strong>, in the same way that <a href="http://stilgherrian.com/music/poll_supernaut_reforms/"><em>I Like It Both Ways</em></a> was without doubt the finest song of the 1970s.</p>
<p>Samantha&#8217;s performance in that video is notable for three reasons:</p>
<ul>
<li>Her breasts</li>
<li>The young man who dances with her who, in my expert opinion, is extremely unlikely to be genuinely interested in said breasts. That&#8217;s professionalism.</li>
</ul>
<p>Last night, Andrew P Street also sang <em>Touch Me</em>. And can I say that the song has a <em>very</em> different meaning when sung by a 35-year-old man who&#8217;s had more than one glass of red wine and who, it must truthfully be said, is not quite as slim as when I first met him more than a decade ago.</p>

News today is that he&#8217;s <a href="http://www.smh.com.au/news/national/mick-keelty-fights-back/2007/07/28/1185339327636.html">blaming everyone else</a> &#8212; but his organisation was in charge of the investigation, wasn&#8217;t it?</li>
<li><strong>Damian Bugg</strong> QC, Director of Public Prosecutions. While he did step in eventually, you&#8217;d have thought that in such a politically-sensitive case he&#8217;d have been involved from the start.</li>
<li><strong>Kevin Andrews</strong>, Minister for Immigration. Dear dear dear, Kevin, first WorkChoices and now this. <a href="http://stilgherrian.com/pollsarchive/">Last week&#8217;s poll</a> suggested you&#8217;d be first voted off the island, and it&#8217;s looking even more likely now.</li>
<li>Attorney-General <strong>Phillip Ruddock</strong>, for sticking his oar into the mess.</li>

			<content:encoded><![CDATA[<p><a href="http://www.boostjuicebars.com">Boost Juice Bars</a> has replied to <a href="http://www.stilgherrian.com/business/boost_call_me_amanda/">my complaint</a> that I&#8217;m annoyed by being asked for my name. All very polite &#8212; but the irony is, the writer hasn&#8217;t revealed <em>their</em> name.</p>

<p>Thank you for your email. </p>
<p>Everyone at Boost works really hard to create a great all round experience for all customers who step into one of our stores. From the brightly coloured store layout, to the music, to the staff who have fun and enjoy what they do, we really do like to live our motto ‘Love Life’. </p>
<p>Asking people for their name is just one part of this. We rarely receive negative feedback regarding this procedure and more often our customers are appreciative that they are not asked to take a ticket and wait for their assigned number to be called. If you wish to call yourself Amanda, or any other name for that matter please feel absolutely free to do so! What we want most is simply to get the freshest, most delicious, made-while-you-wait juice into your hand promptly and efficiently. And, of course, to serve it to you with a smile! </p>

<p>Of course the jolly, nameless customer service droid who&#8217;s composed this response has missed the point. It&#8217;s not that I <em>want</em> to be called Amanda. It&#8217;s that I don&#8217;t want to be referred to a name <em>at all</em>.</p>
<p>If they were <em>actually</em> &#8220;work[ing] really hard to create a great all round experience for all customers,&#8221; they&#8217;d change their procedures to cope with <em>all</em> customers&#8217; preferences. Instead, they&#8217;re saying that most people don&#8217;t complain, so the strategy rolls on regardless &#8212; while we all have fun and smile and enjoy what we do.</p>
<p>Love life.</p>

		<description><![CDATA[Boost Juice Bars annoy me. They always want to know my name, when all _I_ want is juice.]]></description>
			<content:encoded><![CDATA[<p><a href="http://www.boostjuicebars.com">Boost Juice Bars</a> annoy me. It&#8217;s not the product &#8212; that&#8217;s just fruit juice. It&#8217;s not the loud music &#8212; that&#8217;s just a futile attempt to drown out the machines.</p>
<p>No, it&#8217;s because they always want to know my name, when all <em>I</em> want is juice.</p>
<p>For Boost, this is part of &#8220;Our Guarantee&#8221;. I can&#8217;t link to it, they&#8217;ve got one of those <a href="http://www.useit.com/alertbox/20001029.html">stupid Flash websites</a>. But it includes:</p>
<blockquote><p>Be polite enough to call you by your first name.</p></blockquote>
<p>Dodgy grammar aside, this assumes everyone <em>wants</em> to be called by name in a juice bar. I don&#8217;t. Apart from having an unusual name and not wanting to draw attention to it, like many people who grew up in the country I find it <em>rude</em> when a stranger demands my name. And I find it uncomfortable when some teenager calls out my name in a busy shop.</p>
<p>As Allan and Barbara Pease write in <a href="http://www.amazon.com/gp/product/0752858785"><em>The Definitive Book of Body Language</em></a>:</p>
<blockquote><p>People raised in sparsely populated rural areas&#8230; need more Personal Space than those raised in densely populated cities.</p></blockquote>
<p>This applies to psychological space as well as physical. I won&#8217;t tell a stranger my name until I know them a bit better. If I&#8217;m just buying juice, I&#8217;ll probably never see them again. So I&#8217;ll be <em>polite</em>, but I won&#8217;t want them to know anything personal. And I won&#8217;t be so rude as to ask them either.</p>
<p>Boost does this with best intentions. &#8220;Our Guarantee&#8221; also says:</p>
<blockquote><p>Make you feel great, give you something to smile about and always give you a  reason to choose BOOST!</p></blockquote>
<p>But once I&#8217;ve placed my order, handed over cash and received change, that&#8217;s the end of the transaction. Psychologically I&#8217;ve moved into that state called &#8220;staring aimlessly at random objects while waiting&#8221;. A personal question at this point is unsettling.</p>
<p>So Janine Allis, founder of Boost, I&#8217;ll continue to tell your staff my name is <a href="http://www.vanstone.com.au">Amanda Vanstone</a> and let <em>them</em> suffer a little discomfort too. Unless , of course, there&#8217;s another juice bar nearby where I can remain comfortably anonymous.</p>
