@Warlach Question seems to be whether “marriage” is property transaction, childcare contract, or romance and/or sex.

Tue plan: Feel less disgusting via rest; supposedly gym with @SnarkyPlatypus some time; eat healthily.

@julie_posetti Indeed, trying to do a Procrustes with existing defintions of “media”, “publication” etc in law is doomed to failure IMO.

via Twitter Web Client in reply to julieposetti

@julie_posetti But, to say that I was saying defamation law shoudln’t apply AT ALL to new forms of communication misses my point.

via Twitter Web Client in reply to julieposetti

@julie_posetti And my point, then and now, is that if a law doesn’t reflect community knwoledge and vice versa then it’s flawed.

via Twitter Web Client in reply to julieposetti

@julie_posetti Correct. You were indeed aruging that under CURRENT law a person’s knowledge of what constituted publication was irrelevant.

via Twitter Web Client in reply to julieposetti

@julie_posetti Hah! That’s hardly reducing my reputation.

via Twitter Web Client in reply to julieposetti

@julie_posetti What I may have said was CURRENT laws are unworkable. So “they shouldn’t apply” from a practical sense. New laws might.

via Twitter Web Client in reply to julieposetti

@julie_posetti @derekbarry Further, today I’d say that we may need a third cateogry, between “private conversation” and “publication”.

via Twitter Web Client

@julie_posetti @derekbarry … merely that people using them probably don’t think of it as capital-P publication, so changes may be needed.

via Twitter Web Client

@julie_posetti @derekbarry I’ve just been verballed. I never said publication laws shouldn’t apply to Twitter and other social media…

@m1k3y I think I HAVE “embraced the future”. It would certainly explain some of the pain.
